1. General Refund Policy

crystality provides digital software products for visual enhancement of games. Due to the nature of digital products, our refund policy is designed to protect both customers and our business in accordance with applicable United States and Utah state law.

This refund policy applies to all purchases made through crystality.win and is governed by the laws of the State of Utah, United States, without regard to conflict of law principles.

2. No Refund After Download or Access

IMPORTANT: Once you have downloaded the software or accessed your account/license key, you are NOT eligible for a refund.

Under United States law and Utah state regulations, digital products are considered delivered and consumed immediately upon access. Once you access, download, or activate the software, the transaction is considered complete, and standard refund rights for digital products do not apply.

By purchasing our software and accessing your account, downloading the software, or using your license key, you expressly consent to the immediate performance of the contract and acknowledge that you will lose your right of withdrawal once the software has been made available to you.

We track all access attempts, downloads, and license key activations in our access logs. Any evidence of download, account access, or license key usage in our system logs will result in the immediate forfeiture of any refund rights.

3. Refund Eligibility (Before Access)

Refunds may only be considered under the following circumstances, and only if you have NOT yet accessed, downloaded, or used the software:

  • Technical Issues: If the software is completely non-functional due to a technical error on our part, and you have not yet accessed your account or downloaded the software, you may request a refund within 14 days of purchase.
  • Duplicate Purchase: If you accidentally purchased the same product twice, we will refund the duplicate purchase, provided neither license has been activated.
  • Payment Error: If there was an error in the payment processing that resulted in an incorrect charge, we will refund the difference or the full amount if appropriate.

All refund requests must be submitted via email to support@crystality.win within 14 days of purchase and must include your order number and a detailed explanation of the issue.

4. Legal Basis (US Law)

Our refund policy is based on the following United States legal principles:

  • Uniform Commercial Code (UCC): Digital products are considered delivered upon access, and standard return rights do not apply to consumed digital content.
  • Utah Consumer Sales Practices Act: Our policy complies with Utah state consumer protection laws regarding digital product sales.
  • Federal Trade Commission Guidelines: Our clear disclosure of refund terms prior to purchase complies with FTC requirements for digital product sales.

5. Access Logs and Verification

We maintain comprehensive access logs that record:

  • Account login attempts and successful logins
  • Software download events
  • License key generation and activation
  • API access and authentication attempts
  • All access timestamps and IP addresses

These logs serve as definitive proof of whether you have accessed, downloaded, or used the software. Any evidence of access in our logs will result in the denial of a refund request, as this constitutes full performance of the contract and delivery of the digital product under United States law.

6. Subscription Products

For subscription-based products (Weekly, Monthly):

  • Once a subscription period has begun and you have accessed the software, no refund will be provided for that period.
  • You may cancel your subscription at any time, but cancellation does not entitle you to a refund for the current billing period.
  • Future subscription periods will not be charged after cancellation.
  • Refunds for unused subscription periods are not available once the subscription has been activated and accessed.

7. Chargebacks and Payment Disputes

If you file a chargeback or payment dispute after accessing, downloading, or using the software, we will:

  • Provide our payment processor with access logs proving that you accessed the software
  • Reference this refund policy and applicable German law
  • Permanently ban your account and all associated licenses
  • Reserve the right to pursue legal action for fraudulent chargeback attempts

8. Processing Time

If your refund request is approved (which is only possible if you have not accessed the software), refunds will be processed within 5-10 business days. The refund will be issued to the original payment method used for the purchase.
